The Foreign Corrupt Practics Act- The Legal Issues Facing U.S. Companies
One only need look at the financial pages to see that transnational
bribery has gained the attention of enforcement authorities around the
world. Within the past year, stories involving companies in the United
Kingdom, Germany, Italy, Switzerland, China, Japan and Korea, to name a
few, have been common place. In the United States, the Foreign Corrupt
Practices Act (FCPA or Act) celebrated its 30th birthday on December
19th, and, as practitioners will attest, prosecutions and investigations
under the Act involving companies and individuals have picked up in recent
years at an astonishing rate.
